Fines and Penalties

Our Nursing Home Injury Lawyers inspected government records and discovered Blackstone Nursing Home committed the following offenses:

Failed to provide housekeeping and maintenance services.

Based on Environmental Tours and staff interview, the facility staff failed to provide maintenance and housekeeping services to maintain a sanitary and comfortable environment on one of two Nursing Units.

Findings include:

During Environmental Tour on 4/5/17 from 11:50 A.M. to 12:10 P.M., and on 4/6/17 from 10:30 A.M. to 11:00 A.M. with the Maintenance Director, observations indicated: First floor resident’s communal bathroom located between Rooms 4 and 5:

There was a strong musty odor. The shower drain was without a cover. The caulking between the shower floors and walls was cracked and black in color. The grout between the tiles in front of the shower was cracked and missing in some areas. Two tiles behind the toilet on the wall were cracked, and the opposite corner had a one inch line of dirt extending out from the wall. The grout behind the sink, where the floor meets the floor, was black in color with a one inch line of dirt extending out from the wall.

During an interview on 4/6/17 at 12:00 P.M., the Maintenance Director said several tiles needed to be replaced, the shower drain should have had a cover on it, and the bathroom needed a deep cleaning.

Failed to provide rooms that are at least 80 square feet per resident in multiple rooms and 100 square feet for single resident rooms.

Based on observation, record review, and staff interview the facility staff failed to ensure resident bedrooms measured at least 80 square (sq.) feet (ft.) per Resident in multiple resident bedrooms and 100 sq. ft. in single resident bedrooms.

Findings include:

During the initial tour conducted on 4/5/17 observations indicated:

1. Room #3 had 75 sq. ft. per bed.
2. Room #6 had 72 sq. ft per bed.
3. Room #8 had 76 sq. ft. per bed.
4. Room #9 had 78 sq. ft. per bed.
5. Room #18 had 71 sq. ft. per bed.
6. Room #20 had 76 sq. ft. per bed.

The following single resident bedrooms did not contain 100 sq. ft. for one bed:

1. Room #4 had 70 sq. ft. per bed.
2. Room #7 had 77 sq. ft. per bed.
3. Room #11 had 97.5 sq. ft. per bed.
4. Room #14 had 97.5 sq. ft. per bed.
5. Room #15 had 97.5 sq. ft. per bed.

During interview with the Administrator on 4/5/17 at 10:30 A.M., he said he would request a variance for this regulation. At the time of survey, the number of beds and the sq. footage shortfall did not compromise resident health or safety.
